TERMS & CONDITIONS OF CAB SERVICE

• Terms and conditions detailed here govern the use of our services and bookings through website and all other applications and services owned and operated by Evergreen Holidays.
• If you have any questions or need any clarifications about the terms and conditions, please contact us prior to using this website for booking or other dealings.
• All transactions you complete through us are subject to the following terms, conditions and notices as they exist at the time the transaction is done.
• You are responsible for all of your use of our software as well as for the use of your name and payment method (Ex-corporate credit card, personal credit card or other approved methods) to pay for services purchased using our software or site.

CAB SERVICES BOOKING & CONFIRMATION

• We only do for any booking requests through Evergreen Holidays. If a booking request is accepted by us, you will receive a confirmation via e-mail, SMS or other notification systems to your registered e-mail address or phone.
• The confirmation will contain all the relevant details, including that of vehicle and driver, with driver's phone number/ID card.
• We provide the customer the possibility of paying for the booking by cash or by credit/debit card. For online booking, the payment methods available are clearly displayed in the software before you submit the request. For cash bookings, the fare must be paid directly to our company Evergreen Holidays. • If you require amendments for a confirmed booking, please contact Evergreen Holidays office directly or through our website`s 24x7 chat window or helpline number.

WE ARE RESPONSIBLE WE HEAR YOU

• Providing refund and support in the event of cancellation.
• If any customers pays the booking money (in advance) and cancels the trip before 24 hrs of booking then the refund will be made in online mode to customers within 8-10 business days.
• Providing customer support and information in case of any delays/ inconvenience
• The cab driver not departing / reaching on time.
• The cab employees being rude.
• The baggage of the customer getting damaged from our cabs.
• CHILD RESTRAINTS - If the customer require child restraints (baby seats, child seats, booster seats and booster cushions) it will be provided in our vehicles. This might incur an additional charge, with prior brief.

ADVANCE PAYMENTS

For all the services contracted, certain advance payment should be made to hold the booking, on confirmed basis & the balance amount can be paid upon arrival in INDIA (Kerala) but definitely before the commencement of the services. Management personnel hold the right to decide upon the amount to be paid as advance payment, based on the nature of the service & the time left for the commencement of the service.
Apart from above in some cases like Special Train Journeys, hotels or resorts bookings during the peak season (X-Mas, New Year), full payment is required to be sent in advance.

CANCELLATION POLICY

In the event of cancellation of tour / travel services due to any avoidable / unavoidable reasons we must be notified of the same in writing. Cancellation charges will be effective from the date we receive advice in writing, and cancellation charges would be as follows:
60 days prior to arrival: 10% of the Tour / service cost
45 days prior to arrival: 20% of the Tour / service cost
15 days prior to arrival: 25% of the Tour / service cost
07 days prior to arrival: 50% of the Tour / service cost

Cancellations can be made either via our software or by making a call directly to our concerned executive or to our office. Cancellation charges will be applied as follows.
• All journeys -(Excluding journeys for which the pickup is at an airport)
• If a booking is cancelled more than 24 hrs before the pickup, no cancellation charge will be made.
• If a booking is cancelled less than 12 hrs before the pickup and a vehicle has not been allocated yet, no cancellation charge will be made.
• In all other cases a cancellation charge of 50 % will be made.
• Journeys with pick up at an airport, For ASAP bookings, a cancellation charge of ----will be made. (Discuss with MD)
• For advanced booked journeys, if the booking is not cancelled before the requested pick up time a cancellation charge equivalent to the amount of the full fare will be made.
• In case you cancel the trip after commencement, refund would be restricted to a limited amount only which too would depend on the amount that we would be able to recover from the hoteliers/ contractors we patronize. For unused hotel accommodation, chartered transportation & missed meals etc. we do not bear any responsibility to refund.

SOME CANCELLATION AND REFUND POLICIES ARE OUT OF OUR TENDER
1.Refund for hotel payment will follow the hotel’s cancellation policy
2.Train tickets cancellations will follow the Railway’s policy
3.Flight tickets cancellations will follow the airlines company policy

PAYMENT OF THE CANCELLATION FEE
• If a booking is made using a credit or debit card, Green Holidays will charge the cancellation fee on your credit or debit card.

REFUND POLICY

In the event of any situation arising that lead to a request for a customer refund, you should contact us directly and discuss your complaint. We will update you by email or phone.

ONLINE BOOKINGS- KINDLY NOTE

BOOKINGS- It is your responsibility to ensure that your details are correct for online bookings. Your booking is not confirmed until you see the confirmation screen on the Website.
PAYMENT- If booking with the "Pay by Card" option, you agree to pay the Fare at the time you make Your Booking. If booking with the "Pay by Cash" option, you agree to pay the fare to the Evergreen Holidays` driver himself with proper receipt/voucher provided by company.
• If paying by card, in the event that your card payment is refused by your card issuer for whatever reason, Evergreen holidays will not be able to fulfill Your Booking.
• Evergreen Holidays will provide a receipt for payment by email to the mail address you registered with the booking.
• If you do not indicate any additional luggage when booking, resulting in a larger size vehicle being required, that might attract extra charges, which you must pay them directly for.
• In the event that you make any deviations from the route that you entered into the Website, You may be subject to additional charges by Evergreen Holidays in respect thereof and will make such payment directly to Evergreen Holidays.
• CHILD RESTRAINTS- If the customer require child restraints (baby seats, child seats, booster seats and booster cushions) it will be provided in our vehicles. This might incur an additional charge, with prior brief.

CANCELLATION OF BOOKINGS AND REFUNDS THROUGH WEBSITE

• You have the right to cancel bookings made through the website.
• If you decide to cancel a booking you must notify Evergreen Holidays by submitting a cancellation request via the form on the Contact Us page, quoting the booking reference, as per the guidance provided on the Website.
• Where the cancellation is less than one week, for all vehicles carrying 9 or more passengers (unless otherwise specified on the confirmation page and your booking confirmation email) before the agreed time, if you paid by Card then no refund will be due to you.
• If a booking is made using a credit or debit card, Green Holidays will charge the cancellation fee on your credit or debit card.
• If any customers pays the booking money (in advance) and cancels the trip before 24 hrs of cab booking then the refund will be made in online mode to customers within 8-10 business days.

LIMITATIONS AND RESTRICTIONS OF SERVICE

EVERGREEN HOLIDAYS SHALL NOT UNDERTAKE THE CARRIAGE OR DELIVERY OF:

• Money or securities, antiques, precious metals, furs, or jewellery or value, any goods or property (of whatsoever nature) of an intrinsic value of more than 1 .
• Any goods or property of a hazardous, dangerous, inflammable, explosive or noxious nature, or are illegal to possess under existing Law, and/or any goods or property (of whatsoever nature) which may deteriorate in transit.
• We are not responsible for any clause, act or circumstance beyond the control of Evergreen Holidays (including, without limitation, any strike, (official or not) lock-out or other form of industrial action or labour dispute, governmental regulations, legal restrictions, embargoes, fire, flood, Act of God, any consequence of riot, war, invasion, act of foreign enemy, hostilities (whether war be declared or not) civil war, acts of terrorism, rebellion, military or usurped power, confiscation, requisition or destruction of or damage to property by or upon the order of or in the name of any Government or public local authority, or other conditions amounting to force majeure).
• Please note that after the finalization of the Tour/ service Cost, if there are any HIKE in entrance fees of monuments / museums, taxes, fuel cost or guide charges – by Govt of India, the same would be charged as extra.

BEHAVIOUR

• Evergreen Holidays reserves the right within its reasonable discretion to terminate the Trip, if your conduct or behaviour is disruptive in any way and/or affects your safety or that of the driver of the vehicle.
• Passengers are not permitted to take alcoholic drinks onto the vehicles for the purpose of consuming them during the Trip.
• Evergreen Holidays further reserves the right to refuse carriage to any person who is thought to be under the influence of alcohol or drugs

DISPUTES

• If You have any complaint in respect of the service provided by us, You agree to first contact us directly (by phone or email) to resolve this with them within 24 hours of the Agreed Time.
• If you are subsequently unable to resolve your complaint with us, you agree to notify Evergreen Holidays thereof via the form on the Contact Us page or by email.
